In The New Jim Crow, Michelle Alexander shines the light on a criminal injustice system that is locking poor and vulnerable people in a 21st century version of a race class caste system that victimizes families and whole communities. The consolidation of the criminal justice system as a new vehicle for racial control came under Ronald Reagan, who declared the "war on drugs" at a time when drug use was actually on the decline. Some of the statistics and anecdotes Alexander presents are utterly astonishing. I mean, this wasn't a shock to me in any way, but the scale of it was astonishing: seeing rows of black men lined up against walls being frisked and handcuffed and arrested for extremely minor crimes, like loitering, or vagrancy, or possession of tiny amounts of marijuana, and then being hauled off to jail and saddled with criminal records that authorized legal discrimination against them for the rest of their lives. Coded racial messages became the staple of the Republican strategy in the coming decades. And because these reforms have been motivated primarily out of concern about tax dollars rather than out of genuine concern about the communities that have been decimated by mass incarceration, people who have been targeted in this drug war and their families, the reforms don't go nearly far enough. One might assume that the more incarceration you have, the less crime you would have. We have decimated millions of people's lives, locked up and locked out millions of people, but in the places where the war on drugs has been waged with the greatest intensity, places where we have locked up the most people, gone on the most extraordinary incarceration binges, crime rates remain high and have actually increased.
These racist origins, Alexander argues, didn't go away, and the strategies of colorblindness have only grown more sophisticated over time. All of us violate the law at some point in our lives. People will just think you're crazy. What makes this even more tragic is that oftentimes the second and third crimes committed are done in order to survive. Alexander is absolutely right to fight for what she describes as a "much-needed conversation" about the wide-ranging social costs and divisive racial impact of our criminal-justice policies.
